Terms of Service

These Terms of Service ("Terms") govern your access to and use of FormMaker (the "Service"), operated by OptiRank Studio ("OptiRank Studio", "we", "us"). By using the Service, you agree to these Terms.

1. Acceptance of terms

By creating an account or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Service description

FormMaker is a form-building platform that lets you create, publish and collect responses from online forms. We may add, change or remove features over time to improve the Service.

3. User accounts

You are responsible for safeguarding your account credentials and for all activity under your account. You must provide accurate information, keep it up to date, and notify us promptly of any unauthorized use. You must be at least 16 years old to use the Service.

4. Acceptable use

You agree not to use the Service to:

• Break any applicable law or infringe others' rights.
• Collect data deceptively or without proper consent.
• Distribute malware, spam or phishing content.
• Attempt to disrupt, reverse engineer or gain unauthorized access to the Service.

We may suspend or terminate accounts that violate this section.

5. Payment terms

Paid plans are billed in advance on a monthly or yearly basis. Payments are processed by Stripe, Inc. (US). All transactions are in USD. Fees are non-refundable except as required by law or as expressly stated. You can cancel at any time and will retain access until the end of your current billing period. Prorated charges or credits may apply when you change plans mid-cycle.

Prices are exclusive of any applicable local taxes. VAT/GST may be added at checkout for applicable jurisdictions.

6. Intellectual property

The Service, including its software, design and trademarks, is owned by OptiRank Studio and protected by intellectual property laws. You retain all rights to the content you create and the submissions you collect; you grant us a limited license to host and process that content solely to provide the Service.

7. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if required to do so by law. Upon termination, your right to use the Service ceases and we will delete your data in accordance with our Privacy Policy.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, OptiRank Studio shall not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, profits or revenue. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.

10. Governing law

Governing law: Laws of India (Karnataka jurisdiction) for company matters. These Terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes shall be resolved under the laws of India, with jurisdiction in Bangalore, Karnataka.
